About TOU

1. This document presents the Terms Of Use (hereinafter "TOU") of services (hereinafter "Services") provided by Smiz, LLC with variable capital of €5000 (hereinafter "Smiz", "the Company" or "Us"). They (the TOU) determine the contractual framework of the relationship between the users (hereinafter "Users" or "You") of the services offered and the Company.
2. Our Services use resources from the company Ankama Games and concern the game DOFUS developed by Ankama Games. In this context, their terms of use are also to respect.
3. The treatment of your personal data is supervised by our Privacy Policy.

Acceptation of TOU

You acknowledge that you are an individual who has reached the majority age in your country of habitual residence or, if this is not the case and the law of your country of habitual residence requires it, that you have obtained authorization from your legal representative (Parent or Guardian) to access our Services. You also acknowledge that you are capable of entering into a valid contract in accordance with the law, case law or customs of your country of habitual residence.

Access to Services

1. Access to the Services is completely free for all users. The full costs for this access, whether hardware, software or Internet access, are the sole responsibility of the user.
   Some pages, sections and services are reserved to members after identification.
2. Our Services are, in principle, continuously available, with the exception of possible interruptions as described in article 3.4 below.
3. Smiz reserves the right to refuse access to the Services, unilaterally and without prior notification, to any User who does not comply with these terms of use.
4. Smiz reserves the right to interrupt, temporarily suspend or modify access to all or part of the Services without prior notice, in order to ensure maintenance, or for any other reason, without the interruption giving rise to any obligation or compensation.
5. Smiz shall not be held liable in the event of force majeure as defined by law.

Intellectual Property

1. All visual elements that are part of the world of Ankama Games are subjects and protected by French and international laws on copyright and intellectual property and are the exclusive property of Ankama Games.
2. All other visuals are the exclusive property of Smiz or belong to brands for which the Company holds the exploitation rights. You may not use these trademarks or visuals without the written permission of Smiz.

Limits of liability

1. Smiz cannot be held responsible for any inconvenience, material or physical deterioration, total or partial, resulting from the unavailability of one or all of our Services.
2. Smiz accepts no liability for any use of the services that does not comply with the TOU. The Company shall not be liable for any damages, direct or indirect, loss of data or profits, which may result from the use or non-use of the Services, negligence or any other reason associated with the Services.
   Any communication, whether oral or written, shall not give rise to any warranty not stipulated in the TOU.
3. Smiz will not be liable for your errors or omissions; this implies that links from web pages or other pages leading to the Services but not managed by Smiz or from third party sites are outside the scope of the Company, which will not be liable for any inconvenience.
4. Some countries do not allow warranty exclusions or limitations. Therefore, the limitations or exclusions listed may not apply to you.
